ARGUMENTATION USING MAQASID AL-SHARI‘AH BY LIBERAL MUSLIMS: A DESCRIPTIVE AND COMPARATIVE STUDY [الاستدلال بمقاصد الشريعة الإسلامية لدى المسلمين الليبراليين: دراسة وصفية مقارنة]

Abstract


This article seeks to study how the objectives of shari’ah (maqasid al-shari‘ah) that were being used in the argumentation by the liberal Muslim groups differ from the ones used by the traditional Muslim scholars. In so doing, first, we explored the long history of maqasid al-shari‘ah from the early era of the Companions of the Prophet (Sahabah) RA until our modern times. This is to examine the developments and transformations of this concept since its infancy until now, where the maqasid al-shari‘ah is employed widely by the contemporary Muslim scholars in their argumentation, resulted in the emergence of numerous approaches in maqasid al-shari‘ah. This article proceeds to give a detailed account of how the liberal Muslims used this concept of maqasid al-shari‘ah in their writings and discourses, especially with a focus on their method of argumentation. A comparison between these two groups is then made to delineate the similarities and differences in their approaches. As a result, this study found that the method of argumentation used by the mainstream Muslim scholars (‘ulama’ usuliyyin) differed significantly from the one that is used by the liberal Muslim groups. Hence, a clear limit must be set for the general Muslim public to draw a distinction between the legitimate uses of maqasid al-shari‘ah as demonstrated by the mainstream Muslim scholars (‘ulama’ usuliyyin) from its pseudo-argumentations employed by the liberal Muslims.

تهدف هذه الدراسة إلى تسليط الضوء على صور ومظاهر الاستدلال بمقاصد الشريعة الإسلامية لدى الليبراليين من أبناء المسلمين ومقارنة منهجهم بالمنهج العلمي المقرر المعتمد عند الأصوليين، وذلك من خلال استقراء مقالات المسلمين الليبراليين وكتاباتهم فيما يخص وجوه استدلالهم بمقاصد الشريعة ومبرّراتهم لها بالإضافة إلى شرح منهج الأصوليين وضوابطهم في الاستدلال بتلك المقاصد. وتمهيدا لذلك، يقوم الباحثان بسرد حقائق تاريخية حول مظاهر الاستدلال بمقاصد الشريعة عبر العصور ابتداء من عصر الصحابة رضي الله تعالى عنهم مرورًا بعصر التابعين والقرون التي تليه وانتهاء بالعصر الحديث فضلا عن عرض بعض الاتجاهات في استدلالات العلماء المعاصرين بالمقاصد الشرعية عند وقوع التعارض بين المقاصد والنصوص. ولقد توصّل الباحثان إلى أن ثمة فروقا شاسعة بين طرق الاستدلال الصحيحة بمقاصد الشريعة التي ينتهجها جمهور العلماء من الأصوليين وبين المنهج الهمجي الذي يتبناه المسلمون الليبراليون. كما أوصى الباحثان بقية المسلمين بأن يكونوا قادرين على التفرقة بين الاستدلال الصحيح والاستدلال الفاسد كما كان عليه المسلمون الليبراليون في استدلالاتهم بمقاصد الشريعة. وعلى المسلمين أيضا أن يكونوا على وعي وحذر من الفكر الإسلامي الليبرالي الذي يدعو إليه هؤلاء ومحاولتهم في تغيير الشريعة الإسلامية الغرّاء باسم مقاصدها.
