Abstract
The Effect of Whipping Punishment on Syariah Criminal Convicts in Acheh
Whipping punishment conducted in accordance with syariah principles has always been accused of being inhumane as well as ineffective. This article analyses the effect of whipping punishments on convicts who have undergone syariah whippings in the Aceh Province. It strives at fulfilling three objectives. Firstly, it analyses the principles and application of syariah whipping punishment. Secondly, it analyses and identifies the effects of the implementation of the said punishment in the Aceh Province. Thirdly, it also suggests a practical and ideal method of implementing such punishment. Overall, this article is based on a socio-legal research that is analysed qualitatively. The data is collected via various interviews conducted on convicts who have undergone whipping sentence, those who are around the convicts as well as those who have actually witnessed the said punishment. The content of the data is then being critically analysed. Observation method also comes into play in the analysis. The research finds that the interviewed convicts admitted of being shamed when whipped in public. They also admitted of bearing physical pain resulting from such punishment. The convicts as well as those who witnessed the said punishment also admitted to repenting not to commit the offence in future. The above findings prove that syariah whipping punishment implemented in Aceh Province is humane and effective in educating convicts and society. Implementation of such sentence in Aceh is, in actual, capable of responding to all negative accusations and educating the society as well on the humanity and effectiveness of such punishments.
