Pengurusan Efluen Perindustrian Dari Perspektif Undang-Undang

ABSTRAK

Fungsi utama sungai sebagai sumber air bagi kehidupan manusia semakin terjejas berpunca daripada pencemaran yang berlaku akibat aktiviti manusia. Masalah ini juga semakin ketara dengan bertambahnya kilang-kilang perindustrian yang menghasilkan sisa-sisa buangan yang dirujuk sebagai efluen perindustrian. Kertas ini membincangkan kaedah pengurusan sungai melalui pendekatan undang-undang. Penulis menganalisis mekanisme perundangan yakni peruntukan undang-undang berkaitan dengan pencemaran sungai akibat daripada pelepasan sisa atau efluen perindustrian. Sebagai salah satu mekanisme yang mampu mengawal dan mengatasi masalah pencemaran sungai, undang-undang yang dibincangkan adalah Akta Kualiti Alam Sekeliling 1974 dan Peraturan-Peraturan Kualiti Alam Sekeliling (Efluen Perindustrian) 2009. Skop perbincangan mengkhusus kepada peruntukan berhubung dengan kawalan pencemaran hasil pelepasan efluen oleh kilang-kilang industri ke sungai. Selain itu, perbincangan dan beberapa cadangan penambahbaikan dikemukakan dalam bahagian kesimpulan.

ABSTRACT

The main function of river as a source of water for human life is getting affected due to pollution that occurs as a result of human activities. This problem is even more pronounced with the increment of industrial factories that produce waste residues that are referred to as industrial effluent. This paper discusses the management of river through legal approach. The authors analyse the legal mechanism namely the law relating to river pollution resulting from the discharge of industrial waste or effluent. As one of the mechanisms that are able to control and overcome the problem of pollution, the legislations that come under discussion are the Environmental Quality Act 1974 and Environmental Quality (Industrial Effluent) Regulations 2009. The scope of the discussion is on the provisions relating to pollution control resulted from the discharge of effluents by industrial factories to the river. In addition, discussion and some suggestion for improvement are put forward in the conclusion.
